Andy Wyatt earlier today, May 15, sent a letter to the general local media stating he was declining a position on the Board of Directors of Prowers Medical Center because of increased duties regarding his position as Prowers County Assessor. He stated that because Julie Branes was the next candidate in line for majority votes received in the May 8 election, she would take his place on the board. However, PMC Designated Election Official, Audrey Kane stated that under Colorado Statutes, the board fills a vacancy by appointment made by PMC Board of Director members. The Board’s next general meeting will be its annual meeting set for May 23rd at 7pm.
The statute supplied by Kane is listed below:
The correct protocol for a Special District Board vacancy is addressed in Colorado Revised Statute 32-1-905 (2) (a) which states:·
Any vacancy on the board shall be filled by appointment by the remaining director or directors, the appointee to serve until the next regular election, at which time, the vacancy shall be filled by election for any remaining unexpired portion of the term. Our next regular election is scheduled for May 2014.
